1. Acceptance of These Terms

These Terms of Use (these “Terms”) govern your access to and use of the Service. As used in these Terms, “Goodybag,” “we,” “us” and “our” refer to Goodybag; “you” and “your” refer to you; and the “Service” means the Goodybag iPhone app, the Goodybag browser extensions, and the Goodybag web app and website at goodybag.nyc. By installing or using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree to these Terms, you may not use the Service.

2. Eligibility

You must be 18 years of age or older to use the Service.

3. Accounts

An account is required to use the Service, except to view a profile or a link that another user shares with you. You may sign in with Apple, with Google, or with your email address and a code that we send to it. You are responsible for maintaining the security of those accounts and for all activity that occurs under your account. Each person may maintain only one account.

4. Gems and Subscriptions

The Service is free to use. Try-ons use gems. Each new account receives 750 gems on a one-time basis, and the first try-on on each new account is free. Thereafter, each try-on uses gems, and the gems used for a try-on that fails or that you cancel are returned to you. You may purchase an optional subscription for $19.89 per month, which adds 3,550 gems to your account for each month for which you pay, sufficient for 50 try-ons. You may also purchase gems at any time, and gems do not expire while your account is open, including the gems provided by the subscription. Our payment processor bills the subscription and each purchase, and the subscription renews each month until you cancel it. You may cancel the subscription at any time from Manage subscription in Settings, in which case you keep all of the gems in your account, and you will not be charged again. Gems have no cash value and may not be sold or transferred.

5. User Content

Your profile, the photos that you add, and the scores, reactions and comments that you give (collectively, “User Content”) remain yours. You permit us to store your User Content and to display it where you choose: on your profile, to the persons with whom you share a link, and to the user whose share you rate. Any person may report a profile, a share or a comment, and may block a profile. We may remove any User Content that violates these Terms.

6. Purchases and Product Information

The Service helps you try on, save and compare products, and is not a store. The products are sold by the stores, and when you check out, you purchase from the store, on its website and subject to its terms, including its prices, shipping, returns and customer service. Search results, More like this, prices, sizes, stock and alerts are obtained from the stores' own sites and from other third-party sources, may change at any time, and may be out of date or inaccurate. Although we endeavor to keep this information current, we do not guarantee that it is accurate at any given moment, and you should verify the information on the store's page before making any payment. Alerts are provided as a convenience and are not guaranteed.

7. Affiliate Commissions

Certain links within the Service are affiliate links. When you click a product within the Service and make a purchase, the store or an affiliate network may pay us a commission. Any such commission does not change the price that you pay. In the extension, we do not apply our affiliate link when another creator or site referred you to that store.

8. Prohibited Conduct

You may use the Service only for your own shopping. You agree that you will not use bots, scripts or other automated tools to search the Service, create accounts or collect data from the Service; overload or attack the Service, attempt to circumvent its limits and protections, or access data that does not belong to you; create multiple accounts to circumvent limits; copy, resell or recreate the search, data or service of Goodybag; add photos of anyone other than yourself to try things on; post anything hateful, harassing, sexual or violent on your profile or in a comment, or impersonate any other person; or use the Service to violate the law or the rights of any other person. We may suspend or close any account that engages in any of the foregoing conduct.

9. Intellectual Property

The software, design and brand of Goodybag are owned by us. Product names, photos and descriptions belong to the stores and brands that publish them. Goodybag displays them to assist you in shopping, and their display does not imply any partnership with those stores or brands.

10. Changes to the Service and These Terms

We continually improve the Service, and its features may change or be discontinued. We may amend these Terms from time to time, and we will post any changes to these Terms on this page with a new effective date. You may stop using the Service at any time by uninstalling it and deleting your account.

11. Disclaimer of Warranties

TO THE FULLEST EXTENT PERMITTED BY LAW, THE SERVICE IS PROVIDED “AS IS,” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED.

12. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, GOODYBAG SHALL NOT BE LIABLE FOR ANY INDIRECT OR CONSEQUENTIAL LOSSES, OR FOR ANY ACT OR OMISSION OF ANY STORE, AND GOODYBAG'S TOTAL LIABILITY FOR ANY CLAIM SHALL BE LIMITED TO FIFTY U.S. DOLLARS ($50). SOME JURISDICTIONS DO NOT ALLOW THE DISCLAIMERS AND LIMITATIONS IN SECTIONS 11 AND 12, SO THEY MAY NOT APPLY TO YOU.

13. General

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Goodybag regarding the Service. If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions will remain in full force and effect. Our failure to enforce any right or provision of these Terms will not constitute a waiver of that right or provision. You may not assign or transfer these Terms without our prior written consent, and we may assign them without restriction. The section headings in these Terms are for reference only and have no legal effect.
